BCM Break Policy

Meal Periods

Nonexempt employees who work more than five hours in a workday are provided with an uninterrupted, duty-free, 30-minute unpaid meal period that is to begin no later than the end of the fifth hour of work. If working more than 10 hours in a workday, nonexempt employees are provided with a second uninterrupted, duty-free, 30-minute unpaid meal period that is to begin no later than the end of the 10th hour of work. Employees may waive their meal period only when they will complete their workday in six hours or less. If employees work more than 10 hours in a day, they may waive their second meal period only if they take their first meal period and they do not work more than 12 hours that day. Employees must clock in/out for these meal periods and they are free to leave the premises/workstations for their meal periods. Meal periods may not be combined with rest breaks or taken at the beginning or end of a work day. BCM encourages employees to take their meal periods in a timely fashion, but does not have the authority to police that you take your meal periods on time. It is your responsibility to take your meal periods on time. If at any time your work prevents you from taking your full meal periods, or is interrupted, or prevents you from taking them on time, let someone from the Ownership Group know immediately so that we can remedy the situation.

Rest Breaks

BCM provides uninterrupted 10-minute, paid rest breaks at the rate of 10 minutes for every four hours worked, or major portion thereof, to all nonexempt employees. For example, if an employee works over 2 hours, they are entitled to 1 10-minute rest break. If an employee works 6 hours, they are entitled to 2 10-minute rest breaks. Generally, these rest breaks should be taken in the middle of the first half and middle of the second half of your shift. Because these rest breaks are paid, there is no need to clock in/out for them. BCM encourages employees to take their breaks in a timely fashion, but does not have the authority to police that employees take their breaks on time. It is the employee’s responsibility to take meal periods on time. If at any time your work prevents you from taking your full meal periods, your meal period is interrupted by work, or if your work prevents you from taking your meal period on time (before the end of the 5th hour of your shift), let someone from the Ownership Group know immediately so that they can remedy the situation.
